This Candidate Privacy Statement provides information on how we use personal data and describes your privacy rights in relation to the information about you that we process. Please read it carefully.

This statement only applies to information collected directly from you via this website/Portal or in next steps in the application process. For information that we receive through other means, such as our general company website or information received from third-parties that could concern you, please read the relevant separate privacy statements on their own websites or provided to you by any other means by those third-parties.

In this statement, where we say ‘you’ or ‘your’, this means either you or any authorised person acting on your behalf. Where we say ‘we’, ‘us’ or ‘our’, this means Accell Group, with business address at Industrieweg 4, 8444 AR, Heerenveen, the Netherlands, including the relevant Accell Group companies in event of vacancy at any of the Accell Group companies (please see full address details of these Accell Group companies at: www.accell-group.com/en).

COLLECTION OF YOUR INFORMATION AND HOW WE USE IT

When applying for a job at Accell Group we collect and process the personal information that you decide to provide either through employment application forms, through the resume posting and/or the sign-in process. It is not necessary to provide any employment application information to view job openings.

Personal information that we usually collect includes, but is not limited to:

l  Your name, date and place of birth, contact details and qualifications (education, training courses and internships), documents evidencing your identity and right to work and any other information you listed on your resume or CV;

l  If you contact us, in some cases we will keep a record of that correspondence;

In the event that you are selected for a next step in the application process, we may process further personal information provided by you in interviews, by (e)mail and from observations by the recruitment staff you interact with:

l  Feedback about you from our staff and third parties; where you give feedback on others, we may keep that too and that is also considered personal information about you;

l  Details of any disabilities and any accommodations we may need to make for you in the workplace;

l  In some cases we will also collect sensitive personal information where we are permitted to do so by law (so in some countries we will ask you about your background for equal opportunities monitoring);

l  Please see our Cookie Policy for more information about what personal data we collect from you when you visit our website/Portal. The personal data we collect of have about you will either be provided by you directly, come from third parties or will be collected from your activity on our website/Portal and use of our services.

HOW IS MY PERSONAL INFORMATION USED BY ACCELL GROUP?

(1)   To provide you with services in connection to the application process, like examining the fit between your candidate profile and the requirements of the position you applied for or facilitating the process of applying for jobs/assignments. This includes sending your CV to other Accell Group companies or affiliated companies for their consideration;

(2)   To further develop, test and improve our website/Portal, or other existing or new systems/processes to better serve you; this mainly takes place in the context of new IT systems and processes, so that information about you may be used in the testing of those new IT systems and processes where dummy data cannot fully replicate the operation of that new IT system;

(3)   To transfer data to third parties (see below);

(4)   Where necessary, to comply with any legal obligation; and

(5)   We may also process your information to:

a)    Promote the security and protection of people, premises, systems and assets;

b)    Monitor compliance with internal policies and procedures;

c)    Administer communications and other systems used by the Accell Group (including internal contact databases);

d)    Investigate or respond to incidents and complaints;

e)    Comply with obligations and rights and cooperate with investigations carried out by the police, government or regulators; and

f)     Participate in any potential or actual purchase or sale, or joint venture, of all or part of a business or company, that any member of the Accell Group wishes to participate in.

Our processing of personal information for all these purposes is based on various processing grounds like the performance of a contract to which the data subject is a party (purposes 1 and 4-5), processing necessary to comply with legal or regulatory obligations (purpose 4-5) and/or processing necessary in the legitimate interests of Accell Group (purposes 1-3 and 5). When processing is necessary for the legitimate business interests of Accell Group, we ensure that processing is conducted in such a manner that our legitimate interests outweigh any individual’s interest. We shall only process your personal information other than on these grounds with your consent (a further processing ground).

Your information will be retained in the system for a maximum of six (6) months after the procedure has been completed, unless you choose to delete your information (please see below for details on how to access or delete personal information). This is to facilitate your access and application for other job openings at Accell Group and/or to allow Accell Group to contact you should another job opportunity come up which may suit your candidate profile. After this period, you will be sent a reminder so that you can extend the amount of time that we hold your personal information, if you do not reply, Accell Group will delete your candidate profile and personal information.

If you are successful in finding a job with us, we will keep your relevant personal information for a longer period in order to comply with ongoing legal and contractual obligations. Generally, we retain your personal data concerning taxes, employment contracts and any financial information for 7 years and other personal information for 2 years.

WILL ACCELL GROUP DISCLOSE THE PERSONAL INFORMATION THAT I PROVIDE?

We do not sell your information to third parties. We may, however, share it with other Accell Group companies or affiliated companies in the context of fulfilling job vacancies. As our activities require the skills and resources of other companies, we will further need to share your information with selected suppliers in order to perform these activities. These companies will have similar legal obligations to us with regards to safeguarding your information. Alternatively, we will remain responsible to you for what they do with your information. The categories of recipients we share your information with include:

l  our suppliers. We may, for example, engage a supplier to carry out administrative and operational work in support of our relationship with you. The supplier(s) will be subject to contractual and other legal obligations to preserve the confidentiality of your data and to respect your privacy, and will only have access to the data they need to perform their functions; the relevant suppliers are typically IT suppliers (who host or support our IT systems, including information about you), premises management companies (who look after physical security at our buildings, and therefore may need to know about you to allow access to our buildings) and back office finance and accounting management providers (who might need to handle details of candidates in order to process accounts payable and receivable). We may also engage suppliers who provide IT technology services and solutions, which might include video interview and skills assessment tools.

l  members of the Accell Group or affiliate companies in other countries. These may be located in- or outside the European Union; different members of the group fulfill different functions and as result your information may be shared with them for different reasons:
- to provide IT functions for the Accell companies world-wide; those IT functions are located among others in the Netherlands.
- Information is also shared with Accell affiliates world-wide where you have expressed an interest in job opportunities, or where we have identified that you may have particular skills required or helpful in that market. l  We will share your data with government, police, regulators or law enforcement agencies if, at our sole discretion, we consider that we are legally obliged or authorised to do so or it would be prudent to do so.

Please note that this list is not exhaustive and can vary over time.

If we or substantially all of our assets are acquired by a third party, then your information will be transferred to the new owner. The new owner will be subject to the same laws concerning your information as we are. If we sell any business or assets to a third party, in which case we will disclose your data to the prospective buyer, or their advisors, of such business or assets.

TRANSFERS OF YOUR INFORMATION ABROAD

We store your information within the European Economic Area (EEA) or countries that have an adequate level of data protection. These countries have equivalent laws to those of the EEA countries when it comes to your information. Where we share your information with companies based outside (i) the EEA or (ii) countries with an adequate level of data protection, we contractually require these companies to handle your information on a similar basis to us. Further details of any transfer including copies of the safeguards we use are available from us on request.

HOW DOES ACCELL GROUP SAFEGUARD PERSONAL INFORMATION?

Accell Group takes the security of your data seriously. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties.

 

YOUR RIGHTS

You have a number of rights in relation to your personal data.

You have the right to access your data, correct any mistakes in our files, the right to have your personal data erased and to restrict or object to processing. You also have the right to withdraw your consent, opt-out of receiving future marketing, and in some circumstances, you have the right to have your information transferred to you or a third party, and the right to object to profiling and automated decision making.
